End User License Agreement

This is Chill Type’s End User License Agreement (EULA). Please don’t hesitate to contact us if any questions should arise after reading it.

Upon full payment, you are purchasing the rights to use the fonts as specified in this agreement. The license is non-transferable, non-exclusive, non-sublicensable, perpetual and revocable. You are not purchasing the copyrights, trademarks and the designs embodied in the fonts. The copyright remains with Chill Type.

Each client needs their own license. If you are acting on behalf of the end user, you agree that

• the third party accepts this EULA
• the company size is correctly specified during checkout
• you are not asking the end user any other price than specified by Chill Type

If you are the designer working with the license owner, you are covered by the license owner’s license for the duration of the project.

3. Licenses

We offer three distinct license types: Desktop, Web and App. The unifying metric for these license types is the company size. Should you outgrow the license you purchased, you must upgrade the license to match the new company size. There are no subscriptions. You can upgrade your license by sending an e-mail to hey@chilltype.com.

3.1 Desktop License

You can install the fonts you licensed on all of your devices. You can use the Fonts to create print documents, logos, merchandise, static images or videos.

You are not permitted to modify, decompile, alter or edit the the font files under any circumstance.

Outlining the fonts and and editing the vector paths is permitted. Desktop licenses are provided as OTF files.

3.1.1 Logo & Social Media License

You can use the fonts in a logo, if your company size doesn’t exceed 50 people.

You can use the fonts on your social media channels, if your company size doesn’t exceed 10 people.

Should your company exceed these sizes and you would like to use the fonts for logos or your social media channels, please contact hey@chilltype.com for a custom extended license.

3.2 Web License

You can use the fonts on any websites you own. You can only use the @font-face CSS method to load the fonts. Uploading the Font files to publicly accessible sites like GitHub or other public servers is prohibited.

You are not permitted to modify, decompile, alter or edit the the font files under any circumstance.

Web licenses are provided as WOFF and WOFF2 files. Use of OTF files online is not permitted.

3.3 App License

You can use the fonts within any of your apps. The fonts cannot be used to create, save and share any files, documents or graphics.

App licenses are provided as OTF files.

3.4 Trial License

You can use the trial fonts for testing, mockups and experiments. They have a limited character set and no OpenType features.

If you decide to use the fonts for a personal project or for a project with a client, you or your client can purchase an appropriate license.

4. General

4.1 Warranty

We aim to produce our fonts to the highest standards. If you, however, encounter a problem with a Chill Type font you purchased, send us an e-mail with a description of the problem to hey@chilltype.com and we will try to fix it within the next 30 days. If the problem can’t be solved by Chill Type, a refund might be issued which would terminate the license you purchased.

In no event shall Chill Type be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from the use of our fonts.

4.2 Termination

If you breach this contract, your license will be terminated immediately. You are not allowed to use the fonts anymore and must destroy all copies.

4.3 Restrictions

You are not permitted to

• Use the fonts to promote violence, discrimination, or hate
• Share the fonts with anyone who doesn’t have a license
• Embed the fonts without making sure that end users can access them
• Modify, decompile, alter or edit the the font files
• Use the fonts for the training of A.I.
• Upload the font files to publicly accessible sites, servers or repositories
• Use the fonts in an application where unlicensed end users can use them to create, save and share custom designs (e.g. print-on-demand services)

5. Legal

This EULA is governed and construed in accordance with the laws of Austria. Any legal proceedings or disputes will take place in Salzburg, Austria.

This EULA constitutes the complete agreement between us, superseding any previous agreements or discussions. Any modifications or amendments must be mutually agreed upon in writing. If you upgrade your license, this contract fully replaces the one you agreed to at the time of your original purchase.
